Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Mynd ("we," "us," or "our"). They govern your access to and use of the Mynd platform at joinmynd.com, including all features, tools, and services we make available (collectively, the "Platform"). By accessing or using Mynd, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance and Eligibility

By creating an account or using Mynd in any way, you confirm that you are at least 13 years old, or the minimum age required to form a binding contract in your jurisdiction. If you are between 13 and 18 years old, you confirm that you have obtained permission from a parent or legal guardian to use Mynd, and that your parent or guardian has read and agreed to these Terms on your behalf.

You may not use Mynd if you are barred from doing so under the laws of India or any other applicable jurisdiction. If you are accessing Mynd on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

We reserve the right to refuse access to Mynd to any person at any time for any reason.

2. Your Account

You must create an account to access most Mynd features. When you create an account, you agree to:

  • Provide accurate and truthful information — your account must represent you, not someone else;
  • Maintain one account per person — multiple accounts for the same individual are prohibited;
  • Keep your account secure — you are responsible for all activity that occurs under your account; and
  • Notify us immediately if you believe your account has been compromised.

You may not share your account credentials with others. You may not transfer your account to another person. We are not liable for any loss or damage arising from your failure to maintain the security of your account.

3. Usernames

Your username becomes part of your public Mynd URL (joinmynd.com/username) and is a fundamental part of your identity on the platform. When choosing a username, you agree that:

  • Your username must represent you as an individual. It may not impersonate, imitate, or mislead others into thinking you are a different real person, living or deceased;
  • Your username may not be the name — or a recognisable variation of the name — of any living public figure, celebrity, politician, executive, or prominent individual without their explicit written consent;
  • Your username may not be the name of any historical figure that Mynd has created an official Historical Mynd for. The full reserved list is enforced at the platform level;
  • Your username may not include Mynd's brand terms (mynd, joinmynd, admin, support, official, team, and similar); and
  • Your username may not be vulgar, offensive, or otherwise violate these Terms.

Username reclaim: Mynd reserves the right to reclaim, reassign, or permanently retire any username at any time, at our sole discretion, including for brand protection, impersonation concerns, inactivity, or any other reason. We will make reasonable efforts to notify affected users where practical, but we are not obligated to do so and are not liable for any loss arising from a username reclaim.

4. Your Mynd — Personal Mynds

4.1 What a Personal Mynd Is

A Personal Mynd is an AI-powered representation of you, built from content you choose to upload. It is not you. It is an approximation. Responses generated by your Mynd are produced by an AI model and may not accurately reflect your actual views, beliefs, statements, or personality at any given time. Neither you nor Mynd guarantees the accuracy of any output your Mynd produces.

4.2 Your Mynd Must Represent Only You

Your Personal Mynd must represent you — the real person who owns the account. You may not create a Personal Mynd intended to represent, simulate, or impersonate:

  • Any other living person, with or without their consent;
  • Any deceased individual — living or historical — unless they are you;
  • Any fictional character; or
  • Any AI system, bot, or non-human entity.

Creating a Mynd that impersonates another real person is a serious violation of these Terms and will result in immediate account termination without notice. We reserve the right to take legal action where appropriate.

4.3 Public Mynds

When your Mynd reaches the threshold required to go public (as determined by Mynd from time to time), it becomes accessible to anyone at your public URL. By allowing your Mynd to go public, you understand and agree that:

  • Anyone in the world can initiate a conversation with your Mynd;
  • Those conversations are stored by Mynd in accordance with our Privacy Policy;
  • You may access aggregate information about questions your Mynd has received, but not the identities of anonymous visitors; and
  • Visitors who converse with your Mynd are bound by these Terms.

You may make your Mynd private at any time from your settings, which will prevent new visitors from accessing it.

4.4 Content You Upload

You retain ownership of the content you upload to Mynd. By uploading content, you grant Mynd a worldwide, non-exclusive, royalty-free licence to store, process, and use that content for the sole purpose of operating your Mynd and generating your Mynd's responses. This licence terminates when you delete the content or your account.

You warrant that:

  • You own or have the necessary rights and permissions to upload all content you provide to Mynd;
  • Your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party;
  • Your content does not contain material that is defamatory, obscene, illegal, or otherwise harmful; and
  • Where your uploaded content includes communications or information from other people (such as messaging exports), you have considered the privacy implications and have a legitimate basis for uploading it.

We reserve the right to remove any content that violates these Terms, without notice.

5. Historical Mynds

5.1 What Historical Mynds Are

Historical Mynds are curated AI representations of significant historical and intellectual figures, created and maintained exclusively by Mynd. They include figures such as Marcus Aurelius, Albert Einstein, Friedrich Nietzsche, and others we may add over time. Historical Mynds are built from high-quality, curated sources and are subject to a rigorous internal quality control process.

5.2 Ownership of Historical Mynds

All Historical Mynds — including all data, systems, and all associated intellectual property — are the exclusive property of Mynd. No user has any rights to Historical Mynd content. You may not reproduce, copy, distribute, reverse-engineer, or create derivative versions of any Historical Mynd.

5.3 Prohibition on Unauthorised Historical Figure Mynds

You may not use any mechanism on the platform, to create a Mynd representing a historical figure, deceased public figure, celebrity, or any real person other than yourself. Attempting to create an unofficial version of a Historical Mynd — even using a different username or variation of the figure's name — is a serious violation of these Terms and will result in immediate permanent account termination.

This prohibition exists to protect the quality and integrity of the Mynd platform. Unlike some platforms that allow open creation of AI characters, Mynd maintains that all Historical Mynds are official, curated products. Unofficial versions undermine the accuracy and trust that define the Mynd experience.

6. Prohibited Conduct

You agree not to use Mynd to:

  • Impersonate any person, entity, or organisation, including through usernames, Mynd content, or conversations;
  • Harass, threaten, abuse, defame, or harm any individual — including through conversations with Mynds;
  • Upload, generate, or distribute content that is illegal, harmful, obscene, sexually explicit, violent, or promotes self-harm, terrorism, or hate;
  • Collect, scrape, or harvest data from Mynd through automated means without our express written consent;
  • Reverse-engineer, decompile, or attempt to extract the source code or underlying models of the platform;
  • Interfere with or disrupt the platform or its servers, including through denial-of-service attacks or other malicious actions;
  • Circumvent, disable, or interfere with any security feature or access control of the platform;
  • Use Mynd in any way that violates applicable local, national, or international law; or
  • Attempt to jailbreak, manipulate, or reverse-engineer the underlying architecture of any Mynd.

7. AI Outputs — Disclaimer

Mynd uses AI models to generate responses. You acknowledge and agree that:

  • AI outputs may be inaccurate, incomplete, misleading, or outdated;
  • Responses generated by a Mynd — including a Historical Mynd — may not accurately represent the actual views, beliefs, or statements of the person depicted;
  • Mynd outputs do not constitute professional advice of any kind — legal, medical, financial, psychological, or otherwise — and should not be relied upon as such;
  • You should exercise independent judgment when acting on any information provided by a Mynd; and
  • Mynd and its owners are not liable for any decisions you make based on output generated by the platform.

8. Intellectual Property

The Mynd platform, including its design, software, models, systems, brand name, logo, and all content we create (including Historical Mynds and their underlying architecture), is owned by Mynd and protected by applicable intellectual property laws. Nothing in these Terms grants you any ownership over Mynd's intellectual property.

You retain ownership of your personal content as described in Section 4.4. The AI-generated outputs of your Personal Mynd (the responses generated when visitors converse with your Mynd) are not owned by either you or Mynd in any proprietary sense — they are AI-generated content produced using our platform and your content under the licence you have granted us.

9. Third-Party Services and Integrations

Mynd integrates with third-party services including Google Calendar, Gmail, Notion, Linear, GitHub, and others. Your use of these integrations is subject to the terms of service and privacy policies of those third parties. Mynd is not responsible for the conduct of third-party services, and any issues arising from those integrations must be addressed with the relevant third party.

By connecting a third-party service to Mynd, you authorise us to access and take actions within that service on your behalf, as you direct us. You may disconnect any integration at any time from your settings.

10. Paid Features

Mynd is currently available as an early access product. Paid features and subscription tiers may be introduced in the future. If and when paid features are made available, the relevant pricing, billing, and refund terms will be provided to you clearly before any charge is made. Your continued use of any paid feature will constitute acceptance of the applicable payment terms.

11. Termination

11.1 Termination by You

You may delete your account at any time from your settings. Upon deletion, your data will be purged in accordance with our Privacy Policy within 30 days.

11.2 Termination by Mynd

We reserve the right to suspend or permanently terminate your account, without notice or liability, if we reasonably believe that you have:

  • Violated any provision of these Terms;
  • Engaged in impersonation, fraud, or any illegal conduct;
  • Caused harm to the platform, other users, or third parties; or
  • Used Mynd in a way that exposes us to legal risk or reputational damage.

Upon termination for cause, your access to the platform ceases immediately and your content may be deleted without recovery. We are not obligated to retain or return your content upon termination for cause.

11.3 Effect of Termination

Sections 5.2 (Historical Mynd ownership), 7 (AI Outputs Disclaimer), 8 (Intellectual Property), 12 (Limitation of Liability), 13 (Indemnification), and 14 (Governing Law) survive termination of these Terms.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Mynd and its founders, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or relating to your use of or inability to use the platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you have paid us in the 12 months preceding the claim, or (b) ₹1,000 (Indian Rupees one thousand).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Mynd and its founders, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of the platform;
  • Your violation of these Terms;
  • Your content, including any claim that your content infringes the rights of a third party; or
  • Your violation of any rights of another person or entity.

14. Disclaimer of Warranties

The Mynd platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components. We do not warrant the accuracy, completeness, or reliability of any content on the platform, including AI-generated outputs. We may modify, suspend, or discontinue the platform or any feature at any time without notice or liability.

15. Governing Law and Disputes

These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms or the Mynd platform shall be subject to the exclusive jurisdiction of the courts located in [CITY], India.

Before initiating formal legal proceedings, both parties agree to attempt to resolve any dispute informally by contacting us at legal@joinmynd.com. We will make reasonable efforts to resolve the dispute within 30 days.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date at the top of this page and, where appropriate, notify you by email or through an in-platform notice. If you continue to use Mynd after revised Terms take effect, you are deemed to have accepted the revised Terms. If you do not agree to the revised Terms, you must stop using Mynd and delete your account.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Mynd regarding your use of the platform, and supersede any prior agreements between us on the same subject matter. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
